Apple sues Psystar

Apple has finally sued Psystar, the maker of the OpenMac 'er OpenComputers that run the Mac OS.  Psystar had been taunting Apple for months saying that a lawsuit wouldn't hold up in court.  The Mac community was extremely surprised that Apple didn't sick their lawyer hounds on them all these many months - perhaps signifying Apple being open to cloning once again.

Nope. 

Apple doesn't use the O'Melveny Myers (blog killas) but the Townsend and Townsend and Crew IP and trademark guys for IP matters.

Will Apple ever get it?

I am wondering if Apple will ever get IT. The fact that they will make a LOT more money if they simply allow folks to purchase their OS and install it on any Intel system. I am guessing they aren't ever going to get it. Oh well.

the OS runs so well because there is only few hardware configs that it has to use so it can be optimized to run on only these. Releasing OSX to free platforms would result in unsupported hardware all over the place and would finally damage the stable image of OSX... dont think that this would be a good idea. Gotta pay for good performance.
If you like the OS just for simplicity or stability/security you can surely find a linux that matches your interests...

you are missing the point. the apple experience is so nice because it all just works--never are there driver issues et al.

That IS the point

The Apple Experience works so well because Apple knows exactly what hardware it will be running on- processors, logicboards, memory systems, expansion configurations, sound system, wireless, etc etc.

If Apple were to release its OS to general PeeCees then they would be in the exact same boat Microsoft is in, trying to make the OS work with billions of possible architecture, controller and expansion combinations and no-name PC builders that use unique hardware.

Keeping the OS to themselves is one of the smartest things Apple has ever done. Apple is a hardware company, opening the OS would kill them.

I really want to see how this plays out. I'm very big into building my own PC's and I prefer Mac OS X over Windows.

So am I. I'm actually kind of hoping Pystar wins. If they do, I think the best way for Apple to do it would be to keep making OSX how they do now, but release the components that go into their computers to people at a fixed price, so it would cost as much to build a clone as it costs to buy an Apple machine. That way there's no hardware configuration issues to address, people can build their own machines, and only Apple is happy. I'm hoping they don't do that if Pystar wins, but I bet they would.

Apple were just waiting until after the iPhone launch to jump on them. This will make interesting reading in the months to follow.

Will Apple or you ever get it?

Why OSX on non Mac hardware? You get more apps, for one tings... Here is the deal, there are some of us, such as myself, that are software developers. I am developing an application that currently is a Windows application. I would say about one out of every 10 inquires about it ask if the software can or will run on OSX. I would love to port it, but there is no cost effective Apple hardware.

A Mac Mini simply isn't powerful enough, the iMac's, well I simply am not going to invest that type of money into a monitor I cannot use with my PC or future Mac's, so that leaves either a PowerMac or MacBook Pro, both expensive solutions.

In the end it simply isn't worth the cost and my software never gets ported. How looses? Not me, not really, when you consider the time and effort it would take me to develop the Mac version and the fact that (despite the fact the software is for photographers) I still only have 9% of the hits on my web site from Mac's, I am not walking away from all that much money. Buy you, the Mac OSX lovers, loose, you don't get a native Mac version and if you want to use my software (which there is currently no OSX version), you will have to boot into Windows, which one customer does do.

On the other hand, if I could pick up a Psystar for $500~700 that will allow me to the flexability I need in my development, then ya, I would love to port it to Mac, it would be fun.

THe question is, how many more one man shops out there would love to port their apps to OSX, but simply cannot justify the cost? How many great programs are YOU loosing out on because Apple is so hard headed?

For those of you that want to make sure everything "runs smoothly" (oh, my Dad is a Mac person, has been since the Lisa, and he has spent MANY hours pulling his hair out over the OS, so it doesn't always run so smoothly even on Apple hardware), then keep purchasing Apple hardware. But stop sueing others that want to make a "less stable" version for those of us that want to on the OS and give YOU new cool applications.

Oh well, off to my Windows development. Will Apple ever get it, I am still guessing not.

You seem to think pretty

You seem to think pretty highly of your software. Do Mac users really "loose" because you refuse to port your software and open yourself to a whopping 10% of the market? If your theoretical year-over-year revenue is 1 million dollars (if all computers could run your software), then you are forgoing $100,000, right off the bat. 10% is small compared to Windows domination, but any business in any other sector will tell you 10% is a huge opportunity to make money.

The cheapest iMac is 1200 dollars. So you will not fork over the $600 difference + some time learning/writing Mac code to open yourself to 10% of a multi-billion dollar industry? I don't get it.

thats true and consider why you only get 9% of your hits from macs.. you write windows software. its crazy you get the 9 you do, despite having nothing to offer a mac user.

You seem to think that your program will be the best thing since sliced bread. Who cares if us mac users can't utilize your cruddy application. If this program were to be so amazing and everyone would want it you can fork over ~$1,200 to make all that extra money. You seem to be very ignorant and pompous.
